What is the Bombay Court Fees Act, 1959?
The Maharashtra Court-fees Act, 1959 (originally the Bombay Court-fees Act) governs the court fees payable in civil courts across Maharashtra. Court fees are paid by the plaintiff or applicant when filing a suit or application, and the amount depends on the monetary value of the claim (ad valorem fees) or the nature of the relief sought (fixed fees).
Ad Valorem Court Fees in Maharashtra: How Are They Calculated?
For money suits and most civil claims, Article 1 of Schedule I prescribes an ad valorem fee that rises in slabs with the amount or value of the claim. It starts at Rs. 200 for claims up to Rs. 1,000. From Rs. 1,00,000 to Rs. 11,00,000 the fee is Rs. 200 for every Rs. 10,000 or part thereof, and above Rs. 11,00,000 it is Rs. 1,200 for every Rs. 1,00,000 or part thereof, subject to a maximum fee of Rs. 3,00,000.
